The purpose of this policy is to set out Otoqi's obligations and resolutions with a view to processing your personal data securely and in compliance with the applicable regulatory provisions, in particular Regulation (EU) 2016/679 known as the General Data Protection Regulation or "GDPR".
Otoqi, located at 17 rue de l'arrivée, 75015 Paris, is the data controller within the meaning of the RGPD, for the collection and processing of personal data carried out on the Otoqi driver Apple App Store or Google Play Store mobile application, hereinafter "The application"
" The application" ensures that the User ("Conveyor") collects and processes personal information in compliance with the French Data Protection Act n°78-17 of January 6, 1978 and the new European legislation on the protection of personal data.Your requests for information or to exercise your rights may be sent to our Data Protection Officer at the following address: privacy@otoqi.com
Otoqi collects and processes your data in particular in the following cases:
Identifiers and IP address:
- when you identify yourself in "The application"
- when you consult information in the application
Geolocation data:
- when you use the application to execute a Conveying Service
We only process your data if a legal provision authorizes us to do so. We process your data in particular on the basis of the provisions of Art. 6 and Art. 9 of the RGPD, as well as on the basis of consent obtained in accordance with Art. 7 of the RGPD. We use numerous security measures to protect and maintain the confidentiality, integrity and availability of your data. Nevertheless, we draw your attention to the fact that there are security risks inherent in the transmission of data via the Internet, in particular the risk of intrusion.
We, our subcontractors and business partners work to maintain physical, electronic and procedural safeguards for your data in accordance with applicable requirements. We use the following measures, among others: Data encryption, connection security, access restriction, firewall and anti-virus implementation.
All your information is stored on secure servers, either our own or those of our subcontractors or business partners, accessible and used subject to compliance with our security policies and standards (or equivalent standards of our subcontractors or business partners).
We retain your data for as long as is necessary for the purposes for which you provided it to us. Access to your information is restricted to employees who have the appropriate authorizations and who have a defined need to access this information for the purposes indicated above.

Duration of legal proceedings, extinction of legal obligation
Your data may be kept for a period exceeding that referred to above, in particular to enable the fulfillment of a legal obligation or the representation of our legal rights. In this case, we do not keep your data beyond the applicable legal requirements, particularly with regard to limitation periods and the termination of legal proceedings.
We expressly forbid ourselves from disclosing, assigning, transferring or communicating all or part of your information to third parties, with the exception of:
- Service providers and business partners strictly necessary to provide products and services on our behalf:
Google for messaging services
AWSfor hosting our APIs
- Otoqi customers concerned by services provided by couriers using the application to document the provision of servicesD
- Third parties to whom we are obliged to provide information for legal or regulatory purposes, in particular police and judicial authorities.
If any of these third parties are located outside the European Economic Area, we will ensure that they agree to apply the same level of protection as that required in France. In the event of a transfer outside the EU, we will ensure that the appropriate legal safeguards are in place, depending on the specific situation of the place where the data is received.
Otoqi does not carry out any automated processing of personal data, including profiling.
As a data subject, you have the following rights:

We always aim to respond to all requests within 30 days. However, this time limit may be extended if necessary, for reasons linked to the specific law of the party concerned or to the complexity of your request.
Before granting your request and in the event of reasonable doubt as to your identity, we may require the production of proof of identity enabling us to remove this doubt.
In the event that it is not possible for us to grant your request, we will inform you of its rejection and the reasons for it.
